Terms, Waiver & Informed Consent

1. Program Overview
The Fitomics x Blockout VBA Training Lab Access Program (“Program”) provides eligible participants with access to Tonal strength-training equipment and related services at the Fitomics Training Lab located at 133 W Oxmoor Rd, Suite 315, Homewood, AL 35209 (“Facility”). The Program is operated by Fitomics (“Provider”) in partnership with Blockout Volleyball Academy (“Blockout VBA”).
2. Eligibility
Enrollment is available to parents, guardians, and immediate family members of athletes currently enrolled at Blockout Volleyball Academy. Participants under the age of 18 must have a parent or legal guardian co-sign this agreement and provide consent on their behalf.
3. Membership Tiers & Billing
- Training Lab Access — Monthly recurring subscription providing Tonal access during available hours.
- Training Lab Plus — Monthly recurring subscription providing Tonal access, semi-private coaching, nutrition consultation, and periodic 3D body composition scans.
All billing is processed through Stripe. Subscriptions renew automatically on a monthly basis until cancelled. Early adopter pricing is available for the first 30 enrollments and is subject to change after that threshold is met.
4. Cancellation Policy
Either party may cancel the membership with 30 days' written notice. There are no cancellation fees or long-term contracts. Upon cancellation, access will continue through the end of the current billing cycle. Refunds for partial months are not provided.
5. Assumption of Risk & Liability Waiver
Participant acknowledges that the use of exercise equipment, including but not limited to Tonal strength-training machines, involves inherent risks of physical injury. These risks include but are not limited to muscle strains, sprains, fractures, cardiovascular events, and other injuries that may result from physical exertion or equipment use.
Participant voluntarily assumes all risks associated with participation in the Program, including those arising from the condition of the Facility, equipment malfunction, and the actions of other participants or staff. Participant agrees to release, discharge, and hold harmless Fitomics, its owners, officers, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action arising from Participant's use of the Facility and participation in the Program.
6. Informed Consent for Physical Activity
Participant certifies that they are in good physical health and have no medical condition that would prevent safe participation in exercise activities. Participant understands that it is their responsibility to consult with a physician prior to beginning any exercise program.
For Plus tier participants receiving nutrition consultation and/or body composition assessments: Participant understands these services are for informational and educational purposes and do not constitute medical advice, diagnosis, or treatment. Participants with medical conditions affecting diet or body composition should consult their physician.
7. Minor Participant Policy
Participants under 18 years of age must be accompanied by or have written authorization from a parent or legal guardian. The parent/guardian must co-sign this agreement and assumes all responsibilities outlined herein on behalf of the minor participant. All minor participants will receive a mandatory equipment orientation before unaccompanied use.
8. Facility Rules & Conduct
- Sessions must be booked in advance through the designated scheduling system.
- Participants must arrive within 10 minutes of their booked time or the session may be forfeited.
- Proper athletic attire and closed-toe shoes are required.
- Equipment must be used as instructed during orientation and must not be modified or tampered with.
- The Facility is a shared space — please be respectful of other users and staff.
- Provider reserves the right to revoke access for violation of these rules or for conduct deemed unsafe or disruptive.
9. Privacy & Data
Personal information collected during enrollment and participation (including health data for Plus members) will be used solely for the purpose of administering the Program and providing agreed-upon services. Data will not be shared with third parties except as required to process payments or as required by law.
10. Modifications
Provider reserves the right to modify these terms, pricing, available hours, or services with 30 days' notice to active members. Continued participation after the effective date of changes constitutes acceptance of the updated terms.
11. Governing Law
This agreement is governed by the laws of the State of Alabama. Any disputes arising from this agreement shall be resolved in the courts of Jefferson County, Alabama.
Acknowledgment
By enrolling in the Program, I acknowledge that I have read, understood, and agree to be bound by these Terms, the Liability Waiver, and the Informed Consent provisions set forth above. I understand that this agreement affects my legal rights and I have signed it voluntarily.
